How Is Child Custody Handled in Illinois?

Parents are likely to have strong feelings about their child's upbringing, and as a result, divorce proceedings involving child custody may be quite intense. Having an attorney at your side is useful for protecting, enforcing, and understanding your parental rights.

All custody decisions in Illinois are centered around the child's best interests, factoring in their needs, relationship with each parent, their preferences for custody, and many other considerations. The responsibilities of custody are divided up into parenting time and decision-making responsibility, which are often shared between the parents.

The division of parenting time does not have to be 50/50. Depending on the parents' availability and the child's needs, the child may live with one parent while the other parent visits on certain weekends. Of course, this is just one way to divide up custody, and the best parenting plans are tailored to each family's circumstances.

When Is Alimony Awarded in Illinois Divorces?

Spousal support, also known as alimony, can be handled outside of court through a settlement if one spouse agrees to pay the other for a set period of time. The intention of spousal support is usually to help the lower-earning spouse adjust to life after the divorce, especially if they were used to a different standard of living during the marriage.

If the spouses cannot agree on support outside of court, one spouse may choose to petition the judge for an award of alimony. Before deciding if alimony is warranted, the judge will review the particulars of your situation, such as:

  • Each spouse's age and health
  • Each spouse's needs
  • Each spouse's earning capacity
  • Any possible impairment to either spouse's earning capacity
  • Each spouse's custody responsibilities
  • The length of the marriage

If alimony is deemed appropriate, the judge can order it for a set period, usually lasting for a fraction of the marriage. In marriages of 20 years or more, the judge may consider an award of indefinite alimony.

How Will My Marital Property Be Divided?

When spouses cannot agree about how to divide up property in a divorce, it will fall to the courts to decide their marital assets.

Your marital assets largely consist of property acquired during the marriage, as well as separate property that has been commingled with marital assets. Since Illinois is an equitable divorce state, the courts will divide up your property in a fair, but not necessarily equal manner. At Cameron Law Center, LLC, we can represent you in court and advocate for a favorable distribution of assets to protect your financial interests.
